Important: In South Africa, a minor cannot inherit directly. A trust holds the assets until a specified age. Many people choose ages like 25, 30, or even later to ensure maturity.

6Residue Clause

The “residue” is everything left in your estate after all specific gifts, debts, and taxes have been paid. This clause names who will receive that remainder.

7Pet Provision

This is a specific clause to name a trusted person who will take care of your pet(s) after you pass away, and to provide funds for their care.

8Digital Assets

This clause gives your executor the specific legal authority to access and manage your online accounts, social media, emails, and other digital property.

9Funeral & Burial Wishes

State your personal wishes for your burial or cremation. This is not legally binding but is a strong guide for your family and executor.

10Business Interests

If you own any part of a business, this clause gives your executor the power to manage, sell, or continue that business after your death.

11No-Contest Clause

This is a deterrent to prevent beneficiaries from challenging your will. It states that if they challenge it without a valid reason, they will lose their inheritance.

Any beneficiary who challenges this Will without reasonable cause shall forfeit their inheritance, which will then fall into the residue of the estate.

12Foreign Assets

If you own property or assets outside of South Africa, this gives your executor the power to get legal help in those countries to deal with those assets.

14Survival Clause

This is a safeguard that requires a beneficiary to survive you for a certain number of days (e.g., 30 days) to be able to inherit. This prevents an inheritance from going to someone who dies shortly after you.

Simultaneous Death Protection: This clause prevents assets from being transferred to a beneficiary’s estate and then to their heirs, which might not be your intention.

15Codicil & Amendments

This is a reminder that if you want to make changes to your will later, you must do so with a formal amendment (called a codicil) or a new will, signed correctly according to South African law.

✅ CRITICAL NEXT STEPS: Making Your Will Legal

This document is not a valid will until you complete the following steps correctly. Failure to do so will make it invalid.

Print the entire document on plain A4 paper. A digital file is not a valid will.

In the presence of your two witnesses, you must initial the bottom right corner of every single page. This prevents pages from being swapped or tampered with.

You must sign the will at the end in the presence of both witnesses. All three of you must be in the same room together at the same time.

Both witnesses must then sign their names and provide their full addresses in your presence and in each other’s presence.

❗ WARNING: Who Cannot Be a Witness

A witness (or their spouse) CANNOT be a beneficiary in your will. If they are, they will lose their inheritance. Your executor also should not be a witness.

📦 Storage & Registration Advice

Do NOT store the only copy in a bank safety deposit box. The bank will seal it upon death, making it inaccessible to your executor until the Master of the High Court issues a directive, which causes significant delays.
